If a chinese company gets its way, all exports of the iPad would be forced to be halted, leaving Apple with no supplies with regards to new devices. The company called Proview, who is a chinese manufacturer based from Hong Kong, owns the trademark to the name iPad in China.
The company has claimed for some time that the iPad and Apple were infringing on there trademark ownership, however it is only now that the claim is being taken seriously. Apple have already had the iPad taken off all store shelves in China and now the company is going one step further and requesting the iPad is band from being exported. Im no lawyer, but surely if the iPad is being made but not sold in the country then it cant be breaching a trademark.
The company has supposedly agreed to a price for using the trademark with Apple. However according the Apple spokeswomen,Carolyn Wu, Proview are no longer accepting the terms of the agreement that made with Apple in China.
Proview want damages in the region of $1.6 billion dollars, an absurd amount by any standard, if the agreement had been made that is. However with the court date set for Feb 22nd, and in the chinese court system, anything is possible.
What do you think? Do you agree? Is the amount and claim abit farfetched.
